Warranty Policy

LIMITED WARRANTY

Gore Engineering LLC (hereinafter referred to as “Gore Engineering,” “we,” “us,” or “our”) provides this Limited Warranty (the “Warranty”) to the original purchaser (the “Purchaser”) of new civil construction equipment and attachments (individually and collectively, the “Product” or “Products”) manufactured by Gore Engineering and purchased directly from Gore Engineering or an authorized dealer.

This Warranty shall also extend to, and inure to the benefit of, any company or partner of Gore Engineering, including but not limited to its partner company Helimax Global LLC.

This Warranty is subject to the terms, conditions, limitations, and exclusions set forth below. Gore Engineering’s obligation under this Warranty is limited solely to, at its option, the repair or replacement of defective parts as provided herein.

The duration of this Warranty commences on the date of original purchase and varies by Product as follows (or as otherwise specified in the Product documentation or sales invoice):

•  Auger Drives: Five (5) years

•  Augers: One (1) year

•  Hammer Breakers: Two (2) years

•  Grapples: One (1) year

•  Buckets One (1) year

•  Tree Shears One (1) year

•  Stump Planers One (1) year

•  Log Splitters One (1) year

The Warranty period for any repaired or replaced part shall be the remainder of the original Warranty period applicable to the Product.

We aim to fulfill your order with precision and speed. Shipping terms, costs, and delivery timelines are specified at checkout and in our Shipping & Returns Policy. Please note that shipping schedules may vary depending on destinations within Europe.

This Warranty shall be valid only if the Purchaser registers the Product on Gore Engineering’s official warranty portal (accessible via our website) within thirty (30) days of the date of purchase. Registration must include:

•  The Product’s manufacturing serial number(s);

•  The date of purchase;

•  A legible copy of the original purchase receipt or invoice;

•  The Purchaser’s full legal name, mailing address, and telephone number.

Failure to complete registration in accordance with this section shall render the Warranty null and void.

To maintain validity of this Warranty, the Product must at all times:

(a) Be serviced and maintained strictly in accordance with the schedules, procedures, and specifications set forth in the instruction manual supplied with the Product at the time of purchase; and

(b) Be operated within the tolerances, load limits, and operational parameters specified in the instruction manual and any accompanying guides.

The Purchaser shall maintain complete and accurate records of all maintenance and servicing performed on the Product and shall provide such records to Gore Engineering upon request. Failure to comply with these requirements shall void the Warranty.

This Warranty is extended solely to the original Purchaser and isnon-transferable. If the Product is sold, resold, transferred, or otherwise conveyed to any third party at any time during the Warranty period, this Warranty shall immediately become null and void.

This Warranty is valid only in the country in which the Product was originally purchased from Gore Engineering or an authorized dealer. If the Product is exported or otherwise removed to any other country, this Warranty shall immediately become null and void.

If a defect in materials or workmanship covered by this Warranty is reported in accordance with Section 8 below, Gore Engineering’s sole obligation, and the Purchaser’s exclusive remedy, shall be, at Gore Engineering’s option, the repair or replacement of the defective part(s), performed at a Gore Engineering facility or an authorized service center. All repairs or replacements shall be performed using new or remanufactured parts.

Gore Engineering shall not be responsible for any transportation, shipping, labor, removal, installation, or other incidental costs.

To make a claim under this Warranty, the Purchaser must:

(a) Notify Gore Engineering in writing of the alleged defect within seven (7) days of its discovery; and

(b) Provide proof of compliance with all Warranty conditions, including registration, maintenance records, and proof of purchase.

All claims must be submitted to Gore Engineering’s warranty department at the address provided on our website.

This Warranty does not cover, and Gore Engineering shall have no liability for:

(a) Normal wear and tear items (including but not limited to cutting edges, bits, seals, filters, hoses, belts, and consumable parts);

(b) Damage caused by misuse, abuse, overload, accident, negligence, improper operation, or operation outside specified tolerances;

(c) Unauthorized modifications, alterations, or repairs;

(d) Improper storage or exposure to environmental conditions (e.g., corrosion due to weather exposure);

(e) Use of non-genuine or non-approved parts, attachments, fuels, lubricants, or hydraulic fluids;

(f) Maintenance or repairs performed by unauthorized persons or facilities;

(g) Consequential, incidental, indirect, or special damages, including but not limited to loss of profits, loss of use, downtime, rental costs, or equipment replacement costs.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. GORE ENGINEERING MAKES NO OTHER WARRANTIES WHATSOEVER.

This Warranty shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of laws principles.

If any provision of this Warranty is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
